On Wednesday, 10th of November 2010, AmCham in cooperation with PricewaterhouseCoopers d.o.o., organized a Professional Update in Hotel Slon. The topic of event was European Tax Law – What does it mean for me? with European Tax Law Expert Mr. Sjoerd Douma, who is also a part of PwC’s global thought leadership group in the area of EU direct taxation.



Recent developments in EU tax law and in European Court of Justice, decisions have resulted in some concrete opportunities for multi-national businesses to save tax, particularly around withholding tax suffered within Europe. Mr. Douma talked about some of these cash-saving opportunities.

He spoke about three main topics: basics of EU Law, EU policy outlook, and case law update. Firstly, he emphasized that the aims of EU were establishment of an internal market and fair competition, which can be achieved especially through positive harmonization.

Secondly, he also mentioned the Monti report (Towards a Single Market Act – a new strategy for the single market), which was issued in May 2010, CCCTB (Common Consolidated Corporate Tax Base), and Code of Conduct Group (Business Taxation).



Lastly, he gave a few case law examples from: withholding taxes, transfer prices, carry-forward of tax credits, loss relief, exit taxation, anti-abuse legislation, and interest deduction.
